Staff Housing for Restaurants: Wage Rules and Costs

Four housing models for restaurant staff, the verified wage-law limits on charging for housing in the US, UK, Canada and Singapore, how to compare housing with a cash allowance, visa salary floors, and handling housing when a job ends.

Updated September 27, 2026 WashokuJob

Four models cover most restaurant staff housing: temporary cover while the chef finds a flat, a cash housing allowance, an employer-leased flat, or a shared staff house. In the US, UK, Canada and Singapore, wage law limits how much housing you can charge against pay, from the UK's £77.70-a-week cap to Singapore's 25%-of-salary cap. Treat the tenancy and the job as two separate agreements, and decide in writing what happens to the room when either ends.

This page is for an owner deciding whether to house an incoming chef or pay a cash allowance instead, and for whoever runs staff housing day to day. It covers wage-law limits on charging for housing in the US, UK, Canada and Singapore, and how visa salary floors treat housing benefits. For a full relocation package beyond housing, see relocation package for chefs; for visa salary floors by country and total hire cost, see can a restaurant sponsor a chef visa and budgeting an international chef hire. We have not verified housing rules for Australia or the EU.

1. Four housing models

For a chef arriving from Japan, finding a flat is often the hardest part of the move: no local credit history, no references, no deposit ready, and a language barrier with landlords.

ModelHow it worksSuitsWatch out for
Temporary onlyEmployer pays serviced accommodation for a few weeks; chef then rents privatelyCities with a working rental marketAllow time; help with viewings, references, the lease
Housing allowanceFixed monthly amount added to pay; chef rents their own placeIndependent or senior hiresLocal tax treatment; does not solve first-arrival access
Employer lease, individual flatRestaurant leases a flat, provides it free or for a chargeSenior chefs, familiesLease length vs employment length; landlord's consent
Shared staff houseRestaurant leases a larger property; each staff member has a roomResorts, junior cook teamsHouse rules, privacy, disputes spilling into the kitchen

The trade-off across all four: a property to manage, disputes between housemates, and what happens to the chef's home if the job ends. Sections 5 to 7 cover that risk; sections 2 to 4 cover the money.

2. Housing and wages: the rules we verified

The legal question is the same everywhere: whether, and how much, housing can count toward wages, and what you can charge for it.

United States (FLSA)

Federal rules let an employer count the "reasonable cost" of lodging toward wages. Under 29 CFR 531.3, that means no more than actual cost (operating and maintenance, including depreciation, plus up to 5.5% interest on the depreciated capital), never more than fair rental value, never a profit margin. Facilities provided mainly for the employer's own convenience do not count. Several states allow no housing offset against minimum wage at all.

United Kingdom (National Minimum Wage)

Accommodation is the only benefit that can count toward minimum wage, through the accommodation offset: £11.10 a day or £77.70 a week from April 2026 (£10.66 / £74.62 in 2025). Charge more and the excess is deducted from pay that counts toward the minimum wage; if housing is free, the offset is added to pay instead. Check it every pay period if you charge rent close to the National Living Wage (£12.71/hour from April 2026).

Canada (low-wage LMIA positions)

For low-wage Temporary Foreign Worker Program positions, the employer must provide or ensure suitable, affordable housing. Affordable means shelter costs (rent or mortgage, electricity, fuel, water, other municipal services) under 30% of the worker's before-tax income. Suitable means no major repairs needed, to plumbing, wiring or structure. This is a suitability test on the housing itself, not a rent-deduction cap; see LMIA step by step for cooks for the filing.

Singapore (Employment Act)

An employer may deduct pay for accommodation, amenities and services it supplies, but the Ministry of Manpower's rule is exact: the deduction must not exceed the value supplied, and not more than 25% of salary for that pay period. All deductions of every kind together are capped at 50% of salary in one period. There is no fixed offset figure as in the UK; the cap moves with the salary you set.

3. Comparing housing with a cash allowance

None of the four rules hands you a market rent, but each turns into a ceiling for one chef.

Use these ceilings to compare housing with a cash allowance of the same value. Comfortably under the ceiling, in-kind housing is usually the better benefit, since it solves the access problem a cash allowance does not. Close to or above it, a cash allowance is simpler and avoids a wage-law breach if rents rise. We found no single official market-rent figure across these cities; check local listings for the room you would actually offer before setting the number.

4. Housing and visa salary floors

Where a visa sets a minimum salary, free or cheap housing usually cannot fill a gap below it. Australia's Core Skills stream of the 482 visa assesses annual earnings excluding non-monetary benefits against the Core Skills Income Threshold (A$79,423 from 1 July 2026); see hiring a Japanese chef in Australia. Singapore's Employment Pass qualifying salary and COMPASS criterion are both assessed on fixed monthly cash salary; housing is not "fixed" pay. See COMPASS points for chefs. Design rule: provide housing on top of a compliant cash salary, never to make a below-threshold salary look sufficient, and give housing its own section of the offer letter, separate from pay.

5. Write it as two agreements, not one

The single biggest cause of housing disputes is treating the room as part of the job with no separate paper trail for the tenancy. Before the chef moves in, put the following in writing, separate from the employment contract:

Whether the chef gets tenancy rights that override this agreement depends on local law. We have not verified this for any of the four countries; ask a local lawyer before relying on a "housing ends with employment" clause, and set the notice periods above regardless.

7. When the job ends

This is where employer housing causes the most trouble, and one line ("housing ends with employment") is not enough. Notice to quit the room and notice of dismissal or resignation run on separate clocks in most of these countries, and the gap between them is where disputes start.

How the job endsDecide in advance
Resignation, normal noticeHow long the chef may stay after their last working day, and whether rent is still payable.
Dismissal with noticeWhether housing notice runs from the dismissal date or the last working day; write down which.
Summary dismissalThe shortest lawful notice to leave the room, unlikely to be zero; check local tenancy law before setting a move-out date.
Any endingHow and when the deposit is returned, and who inspects the room first.

If the chef is on a sponsored visa, align the housing timeline with departure duties. In Singapore, for example, the employer must buy the Employment Pass holder's air ticket home before cancelling the pass, unless the employee agrees otherwise in writing. See probation reviews and onboarding a chef from Japan.

Figures that expire: the UK accommodation offset resets every April (next check April 2027). Singapore's caps are stable in law; confirm on MOM's site before relying on them. The US and Canadian rules are regulatory, not annual, and change less often.

Frequently asked questions

Can I deduct rent from a chef's wages?

Yes, in the US, UK, Canada and Singapore, but each caps it differently: US actual cost, UK a fixed offset (£77.70/week from April 2026), Singapore 25% of salary and not more than the room's value, Canada a 30%-of-income affordability test on the housing itself. Deducting more can push pay below the legal minimum or fail a visa's housing test.

Is it better to provide housing or pay a housing allowance?

Comfortably under the wage-law ceiling, provided housing is usually better, since it solves the access problem a cash allowance does not for a first-time arrival. Close to or above the ceiling, a cash allowance is simpler and avoids a breach if rents rise.

Does free or subsidised housing count toward a visa's minimum salary?

Generally no. Australia's Core Skills Income Threshold excludes non-monetary benefits, and Singapore's Employment Pass and COMPASS tests look only at fixed cash salary. Provide housing on top of a salary that already clears the threshold, not to make a lower salary work.

What happens to the chef's housing if we dismiss them?

Decide in advance: how long they may stay, whether rent is due, and how the deposit is returned. Local law may give rights that override a "housing ends with employment" clause, so confirm with a lawyer before setting a move-out date.

Do we need a separate tenancy agreement from the employment contract?

Yes. Cover notice periods, dismissal versus resignation, deposits, inspection rights and who pays utilities in a document separate from the job offer, so a dispute about one does not become a dispute about both.

General information, not legal or tax advice. Rules on wage deductions, housing benefits and tenancy vary by country, state and city, and change. Take advice from a local employment lawyer and accountant before providing staff housing.
